Frequently asked questions

Can an HOA charge late fees?

Only if authorized by the governing documents and consistent with state law.

What if the HOA never gave me a copy of the fine schedule?

In Oregon the schedule must have been delivered/mailed to each lot; in Indiana it must be available on inspection. That is a defense worth raising.

State law notes

Indiana: a fine requires a board-adopted schedule first; if this is a FINE (not a standard late fee) the schedule must list the violation, amount, recurring calculation, and max aggregate (IC 32-25.5-3-12(a)), and pre-fine notice is required (3-12(f)).

Oregon: the fine/charge must be based on a schedule in the declaration/bylaws or a resolution delivered/mailed to each lot (ORS 94.630(1)(n)).
